1. GENERAL PROVISIONS

  1. The PROJECT BULGE online store is operated by:

hereinafter referred to as the “Seller” or “PROJECT BULGE”.

  1. These Terms & Conditions set out the rules for using the online store, placing and processing orders, concluding sales contracts, making payments, delivery of Goods, exchanges, withdrawal from the contract, returns and complaints.

  2. The online store operates using the Shopify e-commerce platform, which provides the technological solutions necessary for the operation of the Store, presentation of Goods, placement of orders and handling of the purchasing process.

  3. PROJECT BULGE is the seller of the Goods offered in the Store and the party to the sales contract concluded with the Customer. Shopify is not the seller of PROJECT BULGE Goods and is not a party to the sales contract concluded between the Seller and the Customer.

  4. A Customer may be a natural person, legal person or organizational entity having the legal capacity required to enter into the relevant contract.

  5. To use the Store, the Customer requires a device with Internet access, an up-to-date web browser and an active e-mail address.

  6. Before placing an order, the Customer has the opportunity to review these Terms & Conditions.

2. GOODS AND PRICES

  1. Information about the Goods, including in particular their descriptions, available colors, variants, sizes and prices, is provided on the relevant product pages.

  2. Prices displayed in the Store are gross prices and include applicable taxes where required by applicable law.

  3. Delivery costs are not included in the price of the Goods unless expressly stated otherwise. Available delivery methods and their costs are presented to the Customer before the order is placed.

  4. For deliveries to countries or territories outside the customs territory of the European Union, the order may be subject to import taxes, customs duties, customs clearance fees or other local charges. Unless applicable law provides otherwise, such charges are borne by the recipient of the shipment.

  5. Product photographs are intended to represent the appearance of the Goods as accurately as possible. The actual color of the Goods may differ slightly from what is displayed on screen, particularly due to device settings, lighting or the characteristics of the material.

  6. Minor differences resulting from the production process that do not affect the functionality, essential characteristics or conformity of the Goods with the contract do not, in themselves, constitute a lack of conformity of the Goods with the contract.

3. PLACING ORDERS

  1. Orders may be placed through the Store 24 hours a day, except during possible technical interruptions.

  2. To place an order, the Customer:

a) selects the Goods and the appropriate variant and size,
b) adds the Goods to the shopping cart,
c) provides the information required to process the order,
d) selects an available delivery method,
e) selects an available payment method,
f) reviews the order summary and places the order with an obligation to pay.

  1. Before placing the order, the Customer may review and correct the information provided and the contents of the shopping cart.

  2. After placing an order, the Customer receives an order confirmation at the e-mail address provided.

  3. The sales contract is concluded between the Customer and the Seller in accordance with the information presented to the Customer during the purchasing process.

  4. If an issue arises that prevents the order from being fulfilled, the Seller will contact the Customer.

4. PAYMENTS

  1. Available payment methods are presented to the Customer during the checkout process.

  2. Electronic payments in the Store are handled through Shopify Payments and the payment methods available within this service.

  3. Shopify Payments is Shopify’s integrated payment solution. Individual transactions may be processed with the involvement of relevant payment processors, financial institutions and other service providers cooperating with Shopify.

  4. The availability of specific payment methods may depend, in particular, on the Customer’s country, currency and the terms of the relevant payment method provider.

  5. The Seller does not receive the Customer’s full payment card details where such details are processed directly by the payment service provider.

  6. Where the selected payment method requires advance payment, the order may be processed once confirmation of successful payment has been received.

5. DELIVERY AND ORDER PROCESSING TIME

  1. PROJECT BULGE delivers to the countries and regions available for selection during the checkout process.

  2. Available delivery methods and their costs are presented to the Customer before the order is placed.

  3. Orders delivered within Poland are normally dispatched within 1–2 business days after the order has been accepted for processing.

  4. International orders are usually dispatched within 1–3 business days after the order has been accepted for processing.

  5. In exceptional circumstances, including periods of increased order volume, new collection launches, promotions, holidays, technical issues or other circumstances affecting order processing, preparation time may be extended.

  6. The timeframes indicated above refer to the preparation and dispatch of the order by PROJECT BULGE and do not include the time required for transportation by the carrier.

  7. Any estimated delivery time provided is for guidance only unless expressly stated otherwise.

  8. For international shipments, delivery times may be extended, in particular due to customs clearance or the operations of a local postal operator or carrier.

  9. The Customer is required to provide correct and complete information necessary for delivery of the order.

  10. If a shipment is returned to the Seller for reasons attributable to the Customer, including an incorrect or incomplete address or failure to collect the shipment, the Seller may require the Customer to cover the actual cost of reshipping before the order is dispatched again.

  11. For shipments requiring customs clearance, the Customer should cooperate with the carrier, postal operator or customs authorities where necessary to ensure proper delivery of the shipment.

6. RIGHT OF WITHDRAWAL AND RETURN REQUEST

  1. A Consumer has the right to withdraw from a distance contract without giving any reason within 14 days, subject to the exceptions provided for by applicable law.

  2. The withdrawal period begins on the day on which the Consumer, or a person designated by the Consumer other than the carrier, takes possession of the Goods.

  3. To start the return procedure, the Customer should submit a return request through their order in the PROJECT BULGE online store.

  4. The order can be accessed through the link included in the order confirmation e-mail or by logging into the Customer’s account. After opening the order, the Customer can request a return of the selected Good or Goods.

  5. The request should be submitted before the expiry of the applicable withdrawal period.

  6. Upon receiving the request, PROJECT BULGE reviews it and approves the return request in the system.

  7. Approval of the request in the system is intended solely to facilitate the return process and provide the appropriate instructions and does not limit the Consumer’s statutory right to withdraw from the contract.

  8. Once the request has been approved, the Customer receives instructions on how and where to return the Goods, appropriate to the country from which the return is being made.

  9. The Goods must be returned without undue delay and no later than 14 days from the date on which the withdrawal from the contract was notified.

  10. If the Customer experiences problems accessing the order or submitting a return request, they may contact PROJECT BULGE at info@projectbulge.com.

  11. The direct cost of returning the Goods is borne by the Customer.

7. HOW TO RETURN GOODS

7.1. Returns from Poland

Returns sent from within Poland should be shipped via InPost to:

The Customer should properly protect the Goods during transportation and retain proof of postage.

It is recommended that the order number and the Customer’s name be included in the parcel to allow us to identify the return.

7.2. International Returns – European Union Customs Territory

Returns should be sent to:

We recommend using a registered or tracked shipping service.

For shipments moving within the customs territory of the European Union, a CN22 or CN23 customs declaration is generally not required.

7.3. International Returns – Outside the European Union Customs Territory

The return should be sent using the Customer’s national postal service, using a registered or tracked shipping service, to:

If a CN22 or CN23 customs declaration is required for the shipment, the Customer should complete it correctly.

The description of the contents and the declared value should accurately reflect the actual contents of the shipment and comply with applicable customs requirements.

After dispatching the shipment, the Customer should send the tracking number to info@projectbulge.com.

If a customs declaration is required but has not been completed, the shipment may not clear customs and may be returned to the sender.

7.4. Cash-on-Delivery Shipments

PROJECT BULGE does not accept return shipments sent on a cash-on-delivery (COD) basis.

8. CONDITION OF RETURNED GOODS

  1. Returned Goods should be clean, complete and must not show signs of use beyond what is necessary for ordinary inspection of the product.

  2. In particular, the Goods should not show signs of wear, washing, stains, odors, damage, stretched fabric or any other signs of use.

  3. The Customer may inspect the Goods only to the extent necessary to establish their nature, characteristics, size and functionality.

  4. If the Goods have been used beyond what is necessary for their inspection, the Customer may be responsible for any reduction in their value.

  5. PROJECT BULGE reserves the right to reduce the refund amount accordingly if the condition of the Goods indicates use beyond ordinary inspection.

  6. If, due to the condition of the Goods, the return does not meet the requirements of applicable law, PROJECT BULGE may refuse to accept the return to the extent permitted by law.

9. REFUNDS

  1. In the event of an effective withdrawal from the contract, PROJECT BULGE will refund the payments due to the Customer in accordance with applicable law.

  2. Refunds are generally made using the same payment method used for the original purchase, unless the Customer agrees to another method of refund.

  3. In the event of withdrawal from the entire contract, the refund also includes the cost of the least expensive standard delivery method offered by PROJECT BULGE for the relevant order. If the Customer selected a more expensive delivery method, the additional cost resulting from that choice is not refundable.

  4. PROJECT BULGE may withhold the refund until the Goods have been received or until the Customer provides proof that the Goods have been returned, whichever occurs first, to the extent permitted by applicable law.

  5. Refunds for orders paid through Shopify Payments are initiated through the payment processing system used by the Store.

10. EXCHANGE OF GOODS

  1. A Customer wishing to exchange Goods for another size, color or model should contact PROJECT BULGE by e-mail at:

  1. The message should include the order number, identify the Goods to be exchanged and specify the Goods or variant the Customer would like to receive.

  2. PROJECT BULGE will check the availability of the selected Goods and, if the exchange is possible, update the order accordingly in the system.

  3. The Customer will then receive instructions on how and where to return the Goods to be exchanged.

  4. The cost of sending the Goods back to PROJECT BULGE for an exchange is borne by the Customer.

  5. After receiving and inspecting the returned Goods, PROJECT BULGE will send the Customer the Goods selected as part of the exchange.

  6. For exchanges within Poland, the Customer is charged PLN 12 for shipping the replacement Goods.

  7. For international exchanges, the cost of shipping the replacement Goods is equal to the standard shipping rate applicable in the Store for delivery to the relevant country.

  8. If the price of the new Goods is higher than the price of the original Goods, PROJECT BULGE will send the Customer a request to pay the price difference. The new Goods may be dispatched once the required additional payment has been received.

  9. If the price of the new Goods is lower than the price of the original Goods, PROJECT BULGE will refund the corresponding price difference to the Customer.

  10. Exchanges are subject to the current availability of the selected Goods.

  11. The exchange service is an additional service offered by PROJECT BULGE and does not limit the Consumer’s statutory right to withdraw from the contract or any rights relating to the lack of conformity of the Goods with the contract.

11. COMPLAINTS AND CONFORMITY OF GOODS WITH THE CONTRACT

  1. The Seller is responsible for the conformity of the Goods with the contract in accordance with applicable law.

  2. Complaints may be submitted by e-mail to:

  1. To facilitate the handling of a complaint, it is recommended that the Customer provide the order number, name of the Goods, a description of the issue and the remedy requested by the Customer.

  2. The Customer may attach photographs showing the issue if they are helpful in assessing the complaint. Failure to provide photographs does not deprive the Customer of the right to submit a complaint.

  3. Complaints are handled within the timeframes and in accordance with the rules established by applicable law.

  4. The Seller bears the costs associated with bringing the Goods into conformity with the contract to the extent required by applicable law.

  5. Rights relating to complaints are independent of the right to withdraw from the contract.

12. PERSONAL DATA

Customers’ personal data is processed in accordance with the PROJECT BULGE Privacy Policy, in particular for the purposes of processing orders, payments, deliveries, exchanges, returns, complaints and communication with the Customer.

13. INTELLECTUAL PROPERTY

  1. Content available in the Store, including in particular the PROJECT BULGE name, logo, graphic designs, photographs, videos, product descriptions, texts and other elements of the brand identity, may be protected by copyright, industrial property rights or other applicable rights.

  2. Copying, distributing, publishing or commercially using such materials without the permission of the relevant rights holder is prohibited unless otherwise permitted by applicable law.

14. FINAL PROVISIONS

  1. Contracts concluded through the Store are governed by Polish law. However, the choice of Polish law does not deprive a Consumer of the protection granted by mandatory provisions of the law applicable in the country of their habitual residence, where such provisions apply.

  2. The Seller may amend these Terms & Conditions for valid reasons, including changes in applicable law, payment methods, delivery methods or Store functionality.

  3. Amendments to these Terms & Conditions do not affect rights acquired in connection with orders placed before the amendments take effect.

  4. Matters not regulated by these Terms & Conditions are governed by the applicable provisions of law.
